What was the dispute between Oracle and Oregon?
Unlike many of our engagements, the issues surrounding the work with the State of Oregon did not center around a licensing dispute. Rather, Oracle and Oregon were at odds over a failed ERP project. Specifically, the issue was the disastrous implementation of the Cover Oregon program as part of the Affordable Care Act. Everyone knew the implementation did not go well. Oregon blamed Oracle for the failure, and Oracle blamed Oregon for the failure. The conflict reached a point where there were multiple lawsuits filed by each side. They were not only suing each other, but they were personally suing the Oregon Governor and Oracle CEO. The state’s lawsuit claimed that Oracle was engaged in fraud and racketeering. It couldn’t have been a more acrimonious situation. At the peak of this animosity, the State of Oregon engaged Palisade Compliance through outside counsel to find a path to resolve the issues and provide Oregon with the products and services they needed to service their citizens, and not break the bank.
We helped Oregon build a settlement plan
Within a very short period of time, Palisade Compliance was able to help the state build a settlement plan to resolve these issues once and for all. Working with outside counsel, we guided our client through the process until the State of Oregon received the settlement proposal they found most favorable. In the end, the State of Oregon received software and services valued at over $100m, including a 6 year no-license-cost ULA that provided the state and their citizens with a platform they could use to launch their state operations into the cloud and fast track their digital transformation.
